South Carolina DUI Defense Attorney

A DUI arrest can leave you worried about your license, your job, and what happens next. At The Siler Firm, we help people facing DUI charges understand their options and take the next step with a clear plan.

Attorney Vanisa Siler examines the traffic stop, the officer’s observations, field sobriety tests, breath or blood testing, and any license suspension. Whether this is your first arrest or you have been through the process before, you deserve a defense built around the facts of your case.

A DUI Arrest Can Affect More Than Your Court Case

After a DUI arrest, you may be worried about your license, your job, your record, and what comes next. You may also be trying to make sense of an officer’s account of the stop or a test result you do not understand.

Attorney Vanisa Siler takes the time to examine the evidence and explain the issues in your case. The Siler Firm represents clients facing DUI charges in South Carolina and helps them understand how a related driver’s license suspension may affect their options.

We Look Beyond the Arrest Report

A DUI charge does not answer every question about what happened. We review the reason for the traffic stop, video and audio recordings, the officer’s observations, field sobriety testing, chemical testing, and other available evidence. We compare those materials with the allegations and with your account of the encounter.

Details matter. What a video shows, when an observation was made, and how a test was conducted can all affect the assessment of a case. Vanisa’s litigation and trial experience informs how she reviews the evidence and prepares to challenge it when appropriate.

Your License May Require Separate Attention

The criminal charge and your driving privileges can involve different proceedings. Depending on the circumstances of your arrest and testing, you may face an administrative license suspension with its own procedures and deadlines.

We help clients identify the license issue, understand the available options, and address an administrative hearing when applicable. If driving is essential to your work or family responsibilities, we want to know that from the start.

A Strategy Based on Your Case

Some DUI matters turn on the stop or investigation. Others involve disputed testing, conflicting observations, or questions about what the recording actually shows. We assess the strengths and weaknesses of the evidence, explain your options, and prepare for negotiations, hearings, or trial as your case requires.

You will receive a candid assessment and a defense built around the facts—not an assumption that every DUI case should be handled the same way.

How We Help With DUI Cases

Cocktail Being Poured

DUI Defense That Looks at the Whole Case

A DUI charge involves more than a breath test result or an officer’s conclusion. The Siler Firm examines the evidence and the procedures behind the charge, including:
The traffic stop and arrest:

Why you were stopped, what the officer observed, and whether the arrest was lawful.

Field sobriety tests:

What the tests show, how they were administered, and whether other circumstances affected your performance.

Breath and blood testing:

How a sample was collected or a test was administered, and whether the results can be challenged.

Video and other evidence:

What the recordings, reports, and witness accounts show when viewed together.

Driver’s license issues:

Whether you face a separate suspension and what steps may be available to challenge it.

We also help clients understand the court process, evaluate their options, and prepare for the next decision in their case.

A Defense Built on the Facts

We start by getting the full picture. We review what happened before, during, and after the arrest, including the video, reports, and test records. Then we apply the law to that evidence, identify the issues that matter, and pursue the best achievable outcome for your case.

Frequently Asked Questions

01

What happens after a first DUI arrest in South Carolina?

A DUI arrest starts a criminal case, but an arrest is not a conviction. You may also face a separate driver’s license issue, depending on whether you refused a chemical test or tested at or above 0.15%. The first step is to review your paperwork and any notice of suspension so you know which matters—and deadlines—apply to you.

02

Will I lose my driver’s license after a DUI arrest in South Carolina?

Not every DUI arrest causes an immediate license suspension. South Carolina provides for an administrative suspension when a driver refuses a chemical test or has an alcohol concentration of 0.15% or higher. A DUI conviction can also lead to a separate suspension. If you received a notice of suspension, you generally have 30 days to request a hearing to challenge it.

03

What happens if I refuse a breath test in South Carolina? The answer depends on

Refusing a requested chemical test can trigger a license suspension even before the DUI charge is resolved. For someone with no qualifying prior convictions or suspensions, the refusal suspension is six months. You generally have 30 days from the notice of suspension to request a hearing; the facts of the arrest and whether you were properly advised of your rights may matter at that hearing.

04

Will I have to install an ignition interlock device for a first DUI?

A first DUI conviction can carry an ignition interlock requirement under current South Carolina law. An interlock requirement may also arise in connection with certain administrative license suspensions. The answer depends on whether you have been convicted, whether you received a notice of suspension, and how that suspension is resolved. We can review those separate issues with you before you decide how to proceed.

05

Can a DUI charge be reduced or dismissed in South Carolina?

Possibly, but it depends on the evidence and the circumstances of the case. A defense may involve the basis for the stop, the legality of the arrest, the reliability of testing, or differences between an officer’s report and the video. We review those issues before advising you about negotiations, motions, or trial. Read here about the difference between DUI and DUAC.
